These Terms and Conditions ("Terms") govern your use of the SAMFA Digital website (samfa.online) and the services provided by SAMFA Digital ("we", "us", or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms.
1. Services
SAMFA Digital provides custom software development, SaaS platform engineering, AI automation, mobile launch support, white-label engineering, and related professional services. The specific scope, deliverables, timeline, and pricing for each engagement are defined in a separate written agreement or Statement of Work (SOW) signed by both parties.
2. Engagement Terms
NDA and Confidentiality
An NDA is signed before any technical discussion begins. All client information, including source code, business data, and project details, is treated as strictly confidential and protected under the terms of that agreement.
Milestone-Based Delivery
Projects are structured around defined milestones with fixed scope. Payment schedules, deliverables, and acceptance criteria are documented in the project SOW. Work does not commence until the SOW and any required deposit are received.
Intellectual Property
Upon full payment of all invoices, intellectual property rights for custom-developed work are transferred to the client as specified in the SOW. SAMFA Digital retains the right to use non-identifiable methodologies and general techniques developed during engagements.
3. Google Play Testing Service
The Google Play Closed Testing service operates under the following terms:
- The 14-day testing cycle begins within 3–5 business days of payment confirmation and receipt of your Play Console invite link
- We deploy real physical Android devices — no emulators or bots are used
- We do not require access to your Google Play Console account credentials or source code
- The Re-Test Guarantee applies if Google rejects your production access application after a completed SAMFA testing cycle. One free re-test is provided per original order, with no time limit on redemption
- Results depend on your app meeting Google's policy requirements. We are not responsible for rejections caused by policy violations unrelated to tester engagement signals
- Voucher codes (e.g., PILOT10) are valid for first-time orders only and cannot be combined with other offers
4. Payments and Refunds
All prices are listed in USD. Payment is due as specified in your SOW or at checkout. For the Play Testing service:
- Payment is required upfront before the testing cycle begins
- Refunds are not available once a testing cycle has commenced
- If we are unable to begin your cycle within the stated timeframe, a full refund will be issued
For custom software projects, payment schedules are defined in the SOW. Deposits are non-refundable once work has commenced on the agreed scope.
5. Acceptable Use
You agree not to use our website or services to:
- Submit apps that violate Google Play Developer Policies or any applicable law
- Engage in fraudulent, deceptive, or harmful activities
- Attempt to gain unauthorized access to our systems or infrastructure
- Reverse engineer, copy, or redistribute any of our proprietary methods or tools
We reserve the right to refuse or terminate service to any party engaging in activities we determine to be harmful or in violation of these Terms.
6. Disclaimer of Warranties
Our services are provided "as is" and "as available." While we take every reasonable measure to deliver the outcomes described, we do not guarantee specific results from Google Play review processes, which are subject to Google's sole discretion. We are not affiliated with Google LLC.
7. Limitation of Liability
To the maximum extent permitted by applicable law, SAMFA Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claim arising from a specific service engagement shall not exceed the amount paid by you for that engagement.
8. Indemnification
You agree to indemnify and hold SAMFA Digital harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of our services, or your infringement of any third-party rights.
9. Third-Party Services
Our services may involve third-party platforms including Google Play, payment processors, and cloud infrastructure providers. These services are governed by their own terms and policies, which you are responsible for reviewing and complying with.
10. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation in the first instance. If resolution cannot be reached, disputes shall be submitted to binding arbitration.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the revised Terms.
